I just received a citation. What happens next?

• You must appear at Court on or before the date listed at the bottom of the citation. When you appear, the Court Clerk will explain your options.
• If you plead "not guilty", then the Court Clerk will schedule a time for a pretrial conference. At the pretrial conference, you will talk to the Prosecuting Attorney about your case.
• If you plead "guilty", the Court Clerk can give you information on the penalty.

What is a pretrial conference?

If you pled "not guilty" at your initial appearance (arraignment), then you will be scheduled to have a pretrial conference. At the pretrial conference, you will talk with the prosecuting attorney about your case. You and the prosecuting attorney may come to an agreement to resolve your case at the pretrial conference. If you do not reach an agreement, your case may be scheduled for trial.

How do I get a public defender?

Applications for the public defender are available at the Nez Perce County Courthouse, 1230 Main Street, 2nd Floor, Lewiston, Idaho.

I received a withheld judgment. What happens now?

Once you have successfully completed probation, you will need to file a motion asking the Judge to dismiss your case. The instructions and forms for requesting that your case be dismissed based on a withheld judgment are available here.

How do I have my criminal record expunged?

How do I pay for my citation?

• In Person: Citations can be paid in person by going to the Nez Perce County Courthouse at 1230 Main St, 2nd Floor, Lewiston, Idaho. Citations can be paid in person by cash, check or money order made payable to "District Court", or by credit card. Please note that credit card payments will be subject to an additional processing fee.
• By Phone: Citations can be paid over the phone by calling 208-799-3040. Please note that credit card payments will be subject to an additional $3 processing fee.
• By Mail: Citations can be paid via mail by sending payment (check or money order made payable to "District Court") to District Court, PO Box 896, Lewiston, ID 83501.
• Online: Citations can be paid online by clicking here. Please note that this Court uses the services of iCourt, and takes advantage of internet security in handling of your credit card information. iCourt charges a fee for this service. The amount of the fee is determined by the amount of the payment and is automatically added to your transaction.
• Drop Box: A drop box is located near the back (south side) entrance to the Courthouse at 1230 Main Street, Lewiston, Idaho.

What is a No Contact Order?

A No Contact Order is an order imposed in a criminal case ordering the defendant in the criminal case to stay away from the victim. An individual cannot petition the Court for a No Contact Order.
